What is a MASC and why is it mandatory?
An Alternative Dispute Resolution method is an attempt to resolve the conflict without going to court. Since Organic Law 1/2025 it is, in many civil and commercial matters, a procedural requirement: you must try it before suing.
What is the Confidential Binding Offer?
It is one of the most used MASCs: one party proposes a specific solution to the other which, if accepted, is binding. Its content is confidential; for it to count, it must be sent by a means that proves its receipt.
Why isn't a regular email enough?
A regular email does not reliably prove that the other party received and opened it. Notify, as a trusted third party, certifies delivery, opening, date and IP, which is what is needed for the requirement.
Do I have to disclose the content of the offer?
Not to prove the attempt. It is enough to prove the sending and the receipt; the content is confidential and is provided separately only if the court requires it.
What happens if the other party does not respond?
If the legal term passes without acceptance, silence is understood as rejection and the judicial route opens. The proof of receipt shows you met the attempt.
